Here are the different contracts I created to use for any dog bred/owned by Kodivaro. The applicable contract must be read and signed before any sale or stud service takes place.
Pet/Companion Dog Contract
"Pet Dog" means the dog is sold as a companion/pet or performance prospect only, and is not intended to be exhibited in conformation shows or used for breeding.
"Seller" refers to Sandra Hudspeth, founder/owner of Kodivaro Siberians.
"Buyer" refers to the individual or family seeking to adopt a Kodivaro dog.

The Seller Guarantees:
* Any dog, regardless of age, bred by Kodivaro Kennels (hereafter “dog” refers to both dogs and bitches) is guaranteed to be free of the following:
- Hereditary Joint Disorders (Hip and Elbow Dysplasia)
- Hereditary Eye Disease (moderate or severe) **
- Malocclusion (moderate or severe)
- Patellar Luxation
- Ventricular Septal Defect (VSD)
- Degenerative Myelopathy (DM)
- Greyhound Polyneuropathy (GHPN)
- Hereditary Nasal Parakeratosis (HNPK)
- Malignant Hyperthermia (MH)
- Von Willebrand's Disease (vWD)
** The eye condition known as Pannus/Uberreiter’s Disease is not included in this guarantee. As of yet the exact cause of pannus has not been identified, and while some breeds including Greyhounds are more predisposed to the condition, it is also believed to possibly be caused by environmental factors such as over-exposure to UV radiation.
* This guarantee remains in place for the lifetime of the dog.
* The Seller certifies that all Kodivaro-owned dogs used for breeding have at minimum been tested for Cardiac Disease, Hereditary Eye Disease, Greyhound Polyneuropathy, and Autoimmune Thyroiditis, as recommended by the Greyhound Club of America.
* If a structural defect is suspected, the dog must be x-rayed no later than 36 months (3 years) of age, and the x-rays submitted to the OFA for examination/certification. If the OFA finds the dog to have a hereditary defect of the hips, elbows, or knees, the following requirements must be fulfilled in order to obtain a replacement puppy. It is understood that money is NOT refunded, and that the guarantee is for a replacement pup only.
I. OFA (Orthopedic Foundation for Animals) shall be the final authority regarding diagnosis of joint dysplasia.
II. A copy of the official OFA report must be sent to the Seller.
III. The Buyer may keep the dog if they wish, or return the dog to the Seller.
IV. All freight (shipping) charges for the replacement pup are to be paid by the Buyer, if the Buyer does not come to retrieve the pup in person.
V. Replacement pups may be chosen from any available breeding, from either a current litter or another up to 24 months from the date the dog is diagnosed.
VI. This guarantee applies to the original owner of the dog, and no dog will replaced in the event they are rehomed with a 3rd party prior to consulting the Seller.
* The dog is guaranteed to be free of all inherited eye conditions that will result in severe visual impairment.
- If an eye disorder is suspected, the dog must be examined by a DACVO certified canine ophthalmologist, and a copy of the report must be sent to the Seller in order to receive a replacement pup.
- Non-hereditary disorders of the eye resulting from injury, illness, or malnutrition are not covered under this guarantee.
- As mentioned above, this guarantee does not cover the condition known as pannus, as it is often a late-onset condition and not believed to be entirely hereditary.
* The dog is guaranteed to be free of moderate or severe Malocclusion (misalignment of the teeth which can cause pain or make it difficult to chew or eat).
- This does not cover slightly incorrect bite alignment (an even bite or one that is only slightly overshot or undershot), retained puppy teeth, or mild malocclusion which does not affect the dog's quality of life or require veterinary intervention to remove/reposition the teeth.
* Contagious diseases, injuries, or conditions caused by improper care on the part of the owner are not covered. Any unexpected hereditary conditions which may arise and are not currently able to be predicted or prevented by genetic testing will be handled on a case-by-case basis.
Responsibilities of Buyer:
* This dog shall be maintained and kept under the personal control of the Buyer. This dog shall be given adequate housing, food, veterinary care, basic obedience training, and shall in no manner be mistreated or neglected.
* All dogs leaving Kodivaro Kennels will be microchipped. This microchip will be registered with the new owner's name and contact information before the pup ever leaves the premises. The Seller (Sandra Hudspeth) is to remain as the secondary contact for the dog at all times. Removal of the Seller as a contact from the dog's microchip will render this contract and all guarantees contained therein null and void.
* If circumstances arise that would prevent the Buyer from keeping this dog, the Buyer promises not to discard this dog, and to immediately return the dog, along with its registration papers and medical records, free of charge, to the Seller so that it can be rehomed with another suitable family.
* This dog shall not be turned over to any animal shelter or rescue organization, under any circumstances. Any person found to have given a Kodivaro dog to a shelter or rescue will immediately have any and all contracts that may exist between the Buyer and Seller voided. The Buyer will also be permanently banned from acquiring any other pups, adult dogs, or stud services from Kodivaro Kennels.
* Buyer is instructed to consult with their veterinarian for advice regarding the pup’s vaccination schedule, as well as any future parasite prevention (fleas, ticks, internal parasites, heartworms) that may be needed. Seller advises against inoculations for Rabies, leptospria canicola, and leptospira icterohaemorrhagia (Leptospirosis) until after the age of 12 weeks, due to the adverse reactions which are more likely to occur in puppies under 12 weeks of age.
- The Seller does not recommend the Bordetella (“kennel cough”) vaccination for any dog who is not expected to have regular contact with other unfamiliar dogs (boarding, the groomer’s, a dog show, etc.) and advises it not be given to any pup under the age of 6 months.
* Buyer is to arrange a checkup of the puppy with a qualified veterinarian within 48 hours of sale (excluding weekends and holidays.) Seller shall be notified within two business days if a health problem is diagnosed, and the Buyer will provide the Seller with the name and telephone number of the veterinarian and a copy of the veterinarian’s report on the animal. In the event that the dog/puppy is ill or found to have a defect within this initial 48-hour period, the Buyer is entitled to either a replacement pup or a full refund of the pup's purchase price. If the Buyer wishes to receive a full refund, return the puppy no later than two business days from the date the veterinary report is received by the Seller. (Under no circumstances will the Seller replace, refund, or cover medical expenses for a puppy if not notified of the illness/defect within 48 hours of the diagnosis.)
- Illnesses/defects do not include common parasites such as coccidia, giardia, or minor intestinal worms, as these are common in pups and easily treated.
- Kennel cough is a very common illness in dogs, and especially in puppies after the stress of traveling to a new home. A puppy diagnosed with kennel cough is not eligible for replacement, as the condition is not life-threatening (it is analogous to a human cold) and generally passes within 14 days with or without veterinary intervention.
- Preventable illness or injury which occurs after the puppy is in the Buyer's custody, such as exposure to another dog with a contagious disease, ingestion of a foreign body or poisonous substance, falls/drops, or injury caused by another animal in the household, are not covered under this guarantee.
* Upon the immediate return of the puppy to the Seller, together with the pup’s registration papers, the pup’s purchase price will be refunded to the Buyer or, if desired, moved over to another litter in order to replace the first pup.
- Refund amount is limited to the puppy’s purchase price of $________.
- Seller does not reimburse for veterinary expenses.
The Seller has informed the Buyer of the following:
* The Seller attempts to breed for only even temperaments and healthy puppies with proper structure and breed type. However, as dogs are living creatures, the Seller cannot predict or guarantee against every possible fault (for example, an incorrect bite in adulthood, ear set/position, degree of angulation in the limbs, etc.)
* Socialization and training are encouraged from the moment the pup arrives, as even the best temperament can turn sour if a dog is not given the opportunity to learn how to properly navigate our human world.
* The bones in a young puppy do not calcify until 12+ months of age. As such, strenuous exercise and intense sport training should not begin until at least this age.
* Studies show early spay or neutering can cause joint problems - the Seller recommends waiting until at least 12 months of age to alter a pup, but preferably 18 months.
* Proper nutrition is important to growth and development of the puppy’s structure. Seller recommends providing food that will not promote excessive growth or obesity, as this can bring on joint problems or arthritis in the future.
- This puppy is currently being fed: ___________________________.
- Other recommended brands are: Diamond Naturals, Purina One, and American Journey.
* The Buyer was made aware that if he or she allows the puppy to engage in activities that over-stress the joints before 12 months of age, the chances of Hip Dysplasia (HD) or joint problems may be increased. Such actives include, but are not limited to: prolonged running on hard surfaces such as asphalt/concrete, continuous running/ jumping, intense training, competitive dog sports/agility.
* The Seller recommends the puppy should be walked for 5 minutes per month of its age.
i.e. At 7 months Buyer should be walking the puppy for at most 35 minutes, twice per day. The Seller also recommends going at the puppy’s pace, and not pushing the pup to exercise more than they want to on their own. Some pups may want to walk less and should not be forced to do more.
* Buyer was made aware that malnourishment, high-fat foods, some supplements, and diabetes can bring on eye issues in dogs. These conditions can be prevented by the vigilance of the owner.
Seller Warrants & Agrees:
* The puppy is sound in body and in good general health at the time of the sale. The puppy has had its first inoculations for Parvovirus, Distemper, Adenovirus, and Parainfluenza. For maximum protection Seller recommends that this puppy receive additional inoculations at 9 and 12 weeks of age.
* The puppy has been seen by a licensed veterinarian at 6 weeks of age.

* The Seller will provide the Buyer with all current health records for the puppy.
* Seller will provide the Buyer with copies of all health clearances on the parents of the puppy (CERF eye screenings, OFA exams, genetic test results, etc.)
* The Seller refers all questions regarding inoculations and worming to a qualified veterinarian; these recommendations are merely suggestions which should be discussed with the Buyer's veterinarian.
Spay & Neuter Agreement: Buyer agrees to have the puppy spayed/neutered and proof back to the Seller between the ages of 12 and 18 months of age.

- Males are to be left intact until at least one semen collection/analysis is completed, after the age of 12 months. This is to be done at the Seller's expense, and the Seller will arrange transport to Kodivaro Kennels and collection of the dog by the Seller's veterinarian or, if the dog is too far away for this to be reasonable, shipment and storage of the collected semen.
- AKC Registration Papers will be released and mailed out to the Buyer after proof of spay/neuter has been provided to the Seller.
This contract is valid from the date of the puppy leaves Kodivaro Kennels and throughout the lifetime of the dog, or until the Buyer transfers ownership to a 3rd party with permission from the Seller.
This Agreement is made and signed by both parties to insure the wellbeing and protection of this puppy/dog. If the Buyer breaches any part of this Agreement, the Seller is released from any obligation under this Agreement.

"Show Dog" means the dog is sold with the intention breeding and/or showing in conformation.
"Seller" refers to Sandra Hudspeth, founder/owner of Kodivaro Kennels.

Sale of a pup/dog as a show, breeding, or performance prospect is in no way a guarantee of success in any venue.
* The dog (hereafter “dog” refers to both dogs and bitches) is guaranteed to be OFA certifiable at 24 months of age or later. The dog must be x-rayed by 36 months of age, and the x-rays submitted to the OFA for examination/certification. If the OFA finds the dog to have dysplasia of the hips, elbows, or patellas (knees), the following requirements must be fulfilled in order to obtain a replacement puppy. It is understood that money is NOT refunded, and that the guarantee is for a replacement pup only.
I. OFA (Orthopedic Foundation for Animals) shall be the final authority regarding diagnosis of joint dysplasia.
II. A copy of the official OFA report must be sent to the Seller.
III. If the dog has joint dysplasia, the dog’s registration papers are to be signed over to the Seller.
IV. The Buyer may keep the dog if they wish, rehome with a person mutually agreed upon by both the Seller and Buyer, or return the dog to the Seller. In any case, the dog must be spayed or neutered, and written proof of this from the veterinarian who performed the surgery must be sent to the Seller.
V. All freight (shipping) charges for the replacement pup are to be paid by the Buyer, if the Buyer does not come to retrieve the pup in person.
VI. Replacement pups may be chosen from any available breeding, from either a current litter or another up to 24 months from the date the dog is diagnosed.
VII. This guarantee applies to the original owner of the dog, and no dog will replaced until such time as they are spayed/neutered and proof of alteration has been received by the Seller.
* The dog is guaranteed to be clear of Hereditary Eye Disease (excepting, as above, pannus). The dog must be examined by a DACVO certified canine ophthalmologist between 12-18 months of age, and every year thereafter for the duration of the dog’s show/breeding career. A written report of any heritable eye disease must be submitted to the Seller with written proof that the dog has been neutered or spayed, and the dog’s AKC registration papers must be signed over to the Seller in order to receive a replacement puppy. All guarantees are under identical terms as those regarding Hip and Elbow Dysplasia. Eye guarantee does not cover conditions resulting from injury, illness, or malnutrition.
* The dog is guaranteed to be free of the following genetic conditions: Degenerative Myelopathy (DM); Greyhound Polyneuropathy (GHPN); Hereditary Nasal Parakeratosis (HNPK); Malignant Hyperthermia (MH); and Von Willebrand's Disease (vWD). Genetic testing can be conducted from birth, and the Seller recommends the Buyer conducts all appropriate genetic screenings before the dog is bred in order to be able to guarantee that any future pups are also free of these conditions.
- Dogs produced who are found to be carriers of DM, GHPN, HNPK, MH, or vWD are not eligible for replacement, as dogs who carry the gene do not suffer from the condition themselves and can still be responsibly bred to other gene-tested, non-carrier dogs. Doing so will always produce Clear and/or Carrier dogs, never Affected.
* A show/breeding prospect is guaranteed to be able to produce live offspring.
- In the event that a male fails to sire any pups in at least 3 consecutive breedings, he is to be examined by a veterinary reproductive specialist (theriogenologist) and must have a brucellosis test, physical exam, and semen analysis performed. If the dog is found to be free of brucellosis, a replacement pup will be provided. Any abnormal findings of the physical exam or semen analysis are to be reported to the Seller for their records.
- In the event that a female fails to conceive or whelp any live pups for at least 2 consecutive breedings, she is to be examined by a veterinary reproductive specialist (theriogenologist) and must have a brucellosis test, physical exam, and ultrasound of the reproductive tract performed. If the dog is found to be free of brucellosis, a replacement pup will be provided. Any abnormal findings of the physical exam or ultrasound are to be reported to the Seller for their records.
* Contagious diseases, injuries, or conditions caused by improper care on the part of the owner are not covered. Any unexpected hereditary conditions which may arise and are not currently able to be predicted or prevented by genetic testing will be handled on a case-by-case basis.
Responsibilities of Buyer:
* It is agreed that the dog may only be bred after the age of 24 months, and only after all required health testing has been completed.
- Required health testing means an OFA Cardiac evaluation (auscultation or echocardiogram), AVCO Eye exam, and a DNA test for Greyhound Polyneuropathy (GHPN).
- Additional testing is preferred, to include OFA Patellar exam (Normal is the only passing score), OFA dentition exam, thyroid hormone blood test, genetic screening for DM, HNPK, MH, and vWD (affected dogs shall not be bred). Embark testing for genetic COI is also recommended.
* This dog shall be maintained and kept under the personal control of the Buyer. This dog shall be given adequate housing, food, veterinary care, and basic obedience training, and shall in no manner be mistreated or neglected.
* All dogs leaving Kodivaro Kennels will be microchipped. This microchip will be registered with the new owner's name and contact information before the pup ever leaves the premises. The Seller (Sandra Hudspeth) is to remain as the secondary contact for the dog at all times. Removal of the Seller as a contact from the dog's microchip will render this contract and all guarantees contained therein null and void.
* If circumstances arise that would prevent the Buyer from keeping this dog, the Buyer promises not to discard this dog, and to immediately return the dog, along with its registration papers and medical records, free of charge, to the Seller so that it can be rehomed with another suitable family. Barring this, the Buyer must first contact the Seller for approval if he or she a suitable new home in mind.
* This dog shall not be turned over to any animal shelter or rescue organization, under any circumstances. Any person found to have given a Kodivaro dog to a shelter or rescue will immediately have any and all contracts that may exist between the Buyer and Seller voided. The Buyer will also be permanently banned from acquiring any other pups, adult dogs, or stud services from Kodivaro Kennels.
* Buyer is instructed to consult with their veterinarian for advice regarding the pup’s vaccination schedule, as well as any future parasite prevention (fleas, ticks, internal parasites, heartworms) that may be needed. Seller advises against inoculations for Rabies, leptospria canicola, and leptospira icterohaemorrhagia (Leptospirosis) until after the age of 12 weeks, due to the adverse reactions which are more likely to occur in puppies under 12 weeks of age.
- The Seller does not recommend the Bordetella (“kennel cough”) vaccination for any dog who is not expected to have regular contact with other unfamiliar dogs (boarding, the groomer’s, a dog show, etc.) and advises it not be given to any pup under the age of 6 months.
* Buyer is to arrange a checkup of the puppy with a qualified veterinarian within 48 hours of sale (excluding weekends and holidays.) Seller shall be notified within two business days if a health problem is diagnosed, and the Buyer will provide the Seller with the name and telephone number of the veterinarian and a copy of the veterinarian’s report on the animal. In the event that the dog/puppy is ill or found to have a defect within this initial 48-hour period, the Buyer is entitled to either a replacement pup or a full refund of the pup's purchase price. If the Buyer wishes to receive a full refund, return the puppy no later than two business days from the date the veterinary report is received by the Seller. (Under no circumstances will the Seller replace, refund, or cover medical expenses for a puppy if not notified of the illness/defect within 48 hours of the diagnosis.)
- Illnesses/defects do not include common parasites such as coccidia, giardia, or minor intestinal worms, as these are common in pups and easily treated.
- Kennel cough is a very common illness in dogs, and especially in puppies after the stress of traveling to a new home. A puppy diagnosed with kennel cough is not eligible for replacement, as the condition is not life-threatening (it is analogous to a human cold) and generally passes within 14 days with or without veterinary intervention.
- Preventable illness or injury which occurs after the puppy is in the Buyer's custody, such as exposure to another dog with a contagious disease, ingestion of a foreign body or poisonous substance, falls/drops, or injury caused by another animal in the household, are not covered under this guarantee.
* Upon the immediate return of the puppy to the Seller, together with the pup’s registration papers, the pup’s purchase price will be refunded to the Buyer or, if desired, moved over to another litter in order to replace the first pup.
- Refund amount is limited to the refund of the puppy’s purchase price of $________.
- Seller does not reimburse for veterinary expenses.
Sale Restrictions:
* It is agreed that no offspring of this dog will be sold to any high-volume breeder or “puppy mill,” and will be placed only with breeders working to improve and preserve the breed. This does not apply strictly to show breeders (although some conformation showing is preferred), but can also apply to breeders focusing on sled racing or competitive performance events.
* Buyer agrees to thoroughly interview customers that any future pups produced will be placed with, in order to ensure each pup is placed in an appropriate home.
* In the case of a male pup, the Seller retains the right to use this male for stud services free of charge. The Seller will notify the Buyer in advance if such a service is required and will make all necessary arrangements including payment for pre-breeding screening exams and transport of the male, if required. If the Buyer lives far enough away that “live cover” breedings are not feasible, the Buyer will have the male’s semen collected and shipped to the Seller, at the Seller’s expense.
* The Buyer shall notify the Seller of any titles or awards the dog may earn, in any show or performance venue, so that the Seller can keep the Kodivaro website and social media pages up to date for all dogs produced.
Seller Warrants & Agrees:
* The puppy is sound in body and in good general health at the time of the sale. The puppy has had its first inoculations for Parvovirus, Distemper, Adenovirus, and Parainfluenza. For maximum protection Seller recommends that this puppy receive additional inoculations at 9 and 12 weeks of age.
* The puppy has been seen by a licensed veterinarian at 6 weeks of age.

* This guarantee remains in place for the lifetime of the dog.
* The Seller certifies that all Kodivaro-owned dogs used for breeding have at minimum been tested for Cardiac Disease, Hereditary Eye Disease, Greyhound Polyneuropathy, and Autoimmune Thyroiditis, as recommended by the Greyhound Club of America.
* Seller (Sandra Hudspeth) certifies that she is the lawful owner of the dam and has full legal right to sell its offspring.

The Bitch Owner will pay the Dog Owner a total fee of $__________, with a nonrefundable deposit of $___________ due at the time of the breeding. The remaining balance will be paid upon the successful whelping of the litter. (The Dog Owner may, at her discretion, choose to ask for a pup from the litter in lieu of cash payment at this time, which the Bitch Owner reserves the right to refuse.)
The Bitch Owner will deliver or send the bitch to the Dog Owner and will leave the bitch in the Dog Owner's care for no longer than 10 days, unless otherwise agreed upon by both parties. The Bitch Owner will provide any medication or special dietary requirements for the bitch. The Dog Owner will provide shelter, care, and sustenance for the duration of the bitch's stay. If the Bitch Owner wishes for chilled or frozen semen to be shipped instead of a live cover (dependent on availability), all additional costs related to transport and delivery of the semen, and insemination of the bitch will be the responsibility of the Bitch Owner. All costs related to collection and storage of semen are the responsibility of the Dog Owner.
A successful litter is defined as 1 or more pups born alive and living at least 30 days. If a successful litter does not occur, the bitch will be bred during her next season, provided that the Dog Owner is notified within 30 days of the failure to whelp. If the second attempt fails, the contract will be considered void. If the breeding is to be conducted using chilled or frozen semen, 2 breeding doses/straws will be sent together. If the first breeding fails, the Bitch Owner will be permitted to use the second dose/straw to attempt the breeding again.* As above, if the second attempt fails, the contract will be considered void.
* Any chilled or frozen semen sent to the Bitch owner for the purpose of breeding is to be used ONLY on the bitch listed above. Using semen to breed another bitch not mutually agreed upon between the Dog Owner and the Bitch Owner will immediately void this contract, and the Bitch Owner will be prohibited from engaging in any further transactions with Kodivaro Kennels, including breeding of dogs through live cover or use of frozen or chilled semen and acquisition of puppies/adult dogs for show, breeding, or companionship. The Dog Owner will also pursue damages resulting from a breach of contract, not to exceed $7,500 as permitted by the State of Oklahoma.
